Terms of Service (Public Offer)
1. General
These Terms are a public offer by sole proprietor Anastasia Sergeevna Andreeva (the “Provider”) to any person (the “User”) to use “Vspyshka”, an AI service for photo processing and image/video generation delivered through the Telegram bot @vspyshka_AIbot and its mini app (the “Service”). The User accepts these Terms by opening the bot, pressing “Start”, paying for the Service, or otherwise using it.
2. The Service
2.1. The Service provides access to AI features: photo sessions in ready-made styles, image generation from text or a reference image, and video generation. Some features are free; others are paid according to the plans shown in the bot.
2.2. The Service is for the User’s personal use only and may not be resold or transferred to third parties.
2.3. The Service is for adults only. Users under 18 must not use it.
3. User content and acceptable use
3.1. The User is responsible for the prompts and images they upload (“User Content”) and warrants they hold all necessary rights and consents, including consent of any person depicted.
3.2. It is prohibited to upload images of third parties, or to create images of specific people (including public figures), without their consent; to create unlawful, abusive, sexual-exploitative or infringing content; to interfere with the Service; or to violate applicable law or third-party rights.
3.3. The quality of reference photos affects the result. The Provider is not liable for results that differ from expectations due to low-quality references.
3.4. The Provider may restrict or block access if a violation is detected.
4. Payment and refunds
4.1. Paid features are paid through the integrated payment system according to the selected plan.
4.2. A refund may be requested if, at the time of the request, the User has made no more than 5 generations under the purchased plan or package. After more than 5 generations payments are non-refundable, except in case of a confirmed technical failure on the Provider’s side.

5. Nature of results; disclaimer
5.1. The Service is creative and entertainment-oriented. Results are artistically generated by AI; the Provider does not guarantee likeness to the User or conformity with subjective expectations.
5.2. The Service is provided “as is”. The Provider is not liable for temporary outages, for the content of User Content, or for the way the User uses generated results.
6. Intellectual property
6.1. The algorithms, scripts, texts and interfaces of the Service belong to the Provider.
6.2. Rights to generated images belong to the User to the extent permitted by law. The User grants the Provider a free, perpetual, non-exclusive right to use generated images (without personal data) to demonstrate and promote the Service, unless the User opts out in writing.
7. Personal data
Personal data is processed as described in our Privacy Policy.
8. Final provisions
8.1. These Terms take effect when the User starts using the Service and remain in force indefinitely.
8.2. The Provider may change these Terms; the current version is published on this page and in the bot.
